ORDER

This writ petition is filed with the following prayer: "to issue a writ, order or direction particularly one in the nature of mandamus declaring the inaction on the part of the respondents in releasing Rs.40,000/- to the petitioners in terms of G.O.Rt.No.77 dated 01.03.2005 issued by Government of Andhra Pradesh for the purpose of construction of houses in Revupolavaram and Kotha Revupolavaram Villages, Rayavaram Mandal of Visakhapatnam District, as illegal, unjust, arbitrary, violative of Article 14 of the Constitution of India and consequently direct the respondents herein to forthwith release of Rs.40,000/- to the petitioners for carrying out further construction of houses, which is presently at the basement level and pass such other order or orders".

The contention of petitioners is that though they have constructed houses up to basement level by spending their own funds, the respondents have not released the amount of Rs.40,000/- in accordance with the proceedings dated 07.01.2004 and therefore, they could not carry out further constructions. 3.

Learned counsel for respondents submits that originally, loans were sanctioned for construction of 65 houses by the authorities concerned and the Fishermen Society had submitted a list of 65 persons, who were benefited under the scheme, but the names of petitioners were not mentioned in the said list. He further submits that subsequently, another scheme was launched and the amounts were released to some of the beneficiaries, who were already constructed houses.

Learned counsel for petitioners submits that if any such scheme is launched in future, the respondents may be directed to consider the applications of petitioners.

In that view of the matter, the petitioners are permitted to file applications before the respondents whenever any new scheme for the same benefit is launched, and on filing such applications, the respondents shall consider the same in accordance with law, subject to their eligibility.

Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
