M.Shankaraiah, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4165 OF 2018 ORDER:
This writ petition is filed challenging the inaction of the fourth respondent in taking further steps pursuant to the notice issued on 02.12.2013 by mutating the revenue records in favour of the petitioner. A reading of the notice indicates that on the application filed by the petitioner, a notice was issued inviting objections from the objectors with regard to the mutation of the name of the petitioner pursuant to his purchase of land of an extent of Acs.1.22 guntas in Survey No.53 under document No.1376 of 1985.
The learned Government Pleader, on the basis of the written instructions, submits that neither the said notice nor the connected record is available in the office of the fourth respondent and if an appropriate application is filed by the petitioner, his case would be considered in accordance with law.
In view of the said statement, this writ petition is disposed of giving liberty to the petitioner to file appropriate application under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act within a period of two weeks from the date of receipt of a copy of this order. As and when such application is filed, the fourth respondent shall consider the same and pass appropriate orders within a period of eight weeks thereafter.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
