HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.5373 and 5529 of 2008 COMMON ORDER:
In both the Writ Petitions, petitioners question notification dated 27.02.2008 issued under Section 4(1) of the Land Acquisition Act, 1894 (the Act) and applying the urgency clause under Section 17(4) of the Act, thereby, dispensing with the enquiry under Section 5A depriving their valuable right to be heard on their objections. This Court, in both the writ petitions, stayed all further proceedings pursuant to the notification dated 27.02.2008. No counter affidavit is filed denying the allegations made by the petitioners.
Learned Government Pleader for land Acquisition has placed on record the instructions dated 09.06.2017 from the Revenue Divisional Officer, Jangareddigudem, wherein it is stated that the Government decided to drop land acquisition proceedings issued pursuant to the notification dated 27.02.2008.
In the light of the subsequent developments, and as the Government decided to drop land acquisition proceedings pursuant to notification dated 27.02.2008, Writ Petitions are allowed. It is however made clear that land acquisition proceedings under the impugned notification cannot be proceeded further.
