THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.255 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.710 of 2015 on the file of Saifabad Police Station, Hyderabad, registered for the offences punishable under Sections 468 and 420 IPC.

Heard and perused the material available on record. The petitioner is alleged to have supplied fake bank statements and other fake documents to A1, who is doing Visa processing work to the Students.

Learned Counsel for the petitioner submitted that the petitioner is no way concerned with the above offences and basing on the confessional statement made by A1, the petitioner was implicated in the case.

This Court is of the view that the confession of the co-accused is not admissible at the time of trial. But, for the purpose of investigation, the confession can be relied. Further, the confession of A1 disclosed the fact that the petitioner also supplied fake bank statements and other documents whenever A1 is in shortage of such documents. Since the allegations made against the petitioner are serious in nature, this Court is not inclined to grant anticipatory bail to him at this stage.

Accordingly, the criminal Petition is dismissed. _______________ RAJA ELANGO, J January 19, 2016.
