THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11562 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.5 seeking to modify the order dated 9.10.2015 passed by the VIII Metropolitan Magistrate, Cyberabad at Rajendra Nagar, in Crl.M.P.No.1608 of 2015 in Crime No.144 of 2015. The petitioner filed the above Crl.M.P. seeking to grant interim custody of the vehicle seized in the above crime. The learned Magistrate passed the order under revision granting interim custody of the vehicle to the petitioner on certain conditions. One of the conditions is that the petitioner shall execute a personal bond for a sum of Rs.5,00,000/- with one surety for the like sum. Aggrieved by the said condition, the petitioner filed this petition.

Heard and perused the material available on record. Considering the facts and circumstances of the case, the above condition imposed by the learned Magistrate directing the petitioner to execute a personal bond for a sum of Rs.5,00,000/- with one surety for the like sum, is modified to that of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like sum. Rest of the conditions shall remain.
