THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27857 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of respondent Nos.2 to 4 in granting permission to the petitioner for construction of compound wall and tin shed, as illegal and arbitrary.

Heard the learned counsel for the petitioner, the learned Government Pleaders appearing for respondent Nos.1 to 3, and the learned Standing Counsel appearing for respondent No.4. 3.

The petitioner claims that he is the owner of an extent of 604.44 square yards equivalent to 505.31 square metres in Survey No.1607/2 of Chelpur Village, Huzurabad Mandal, Karimnagar District. It is the case of the petitioner that now Chelpur Village is merged in Shalapalli - Indiranagar Gram Panchayat. A perusal of the record reveals that the petitioner submitted a representation to the fourth respondent on 01.04.2016 seeking permission for construction of compound wall and tin shed.

At the time of hearing, the only relief sought for by the learned counsel for the petitioner is to direct the fourth respondent to dispose of the representation of the petitioner dated 01.04.2016 as expeditiously as possible. The learned Standing Counsel for Gram Panchayat also consented for the same.

In view of the submissions made by both the counsel, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the fourth respondent is hereby directed to consider and dispose of the representation of the petitioner dated 01.04.2016 in the light of the provisions of the A.P.Panchayat Raj Act, 1994 and the Rules made thereunder, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. 7.

With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
