THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4150 OF 2018 ORDER:

The case of the petitioner is that his father was having several extents of lands in different survey numbers, namely, Survey Nos.367 to 379, to a total extent of Acs.26.21 guntas situated in Aswaraopet Village. His father was given pattadar pass books and title deeds, and after the death of his father, pattadar pass books and title deeds were issued in the name of his mother. The petitioner is the only son to his parents. Unfortunately, his mother also expired on 03.06.2005. The petitioner submitted an application for mutating his name in the revenue records and when no action was taken on his application, the present writ petition is filed.

The learned Government Pleader, on the basis of the written instructions, submits that the said land is situated in scheduled area and the petitioner sold the said land to some non-tribal persons under sada sale deeds. The purchasers, namely, Smt.Sanaboina Lakshmi, Smt.Sanaboina Bhagya Lakshmi and Manne Nageswara Rao have been raising objections on the claim of the petitioner. Hence, appropriate proceedings would be issued by the Tahsildar after conducting detailed enquiry.

In view of the written instructions obtained by the learned Government Pleader, the second respondent is directed to consider the application of the petitioner, dated 22.11.2017 and pass appropriate orders in accordance with law after hearing the objectors and the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 19.02.2018 pln
