Respondents Petition under Article 226 of the Constitution of India, praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents herein particularly Respondent No. 3 in interfering with the petitioner's business activity in the Shop with D.No.
2-107 situated in the Shandy near Devi Chowk Centre, Rangampeta Village and Mandal, East Godavari District and directing him to remove the shop without issuing any notice and without having any authority as illegal, arbitrary, erroneous, high handed and violative of Article 19 and 21 of Constitution of India and consequently direct the Respondent No. 3 not to interfere with the petitioner's business activity in the shop with D.No. 2-107 situated in the Shandy, near Devi Chowk Centre, Rangampeta Village and Mandal, East Godavari District. WPMP. NO.
Petition under Section 151 of C.P.C. paying that in the circumstances stated in the affidavit filed in W.P. the High Court may be pleased to direct the respondent No.3 not to interfere with the petitioners business activity in the shop with D.No.2-107 situated in the Shandy, near Devi Chowk Centre, Rangampeta Village and Mandal, East Godavari District, pending WP No. 2480 of 2015 on the file of the High Court. The petition coming on for hearing, upon perusing the petition and the affidavit filed herein and order of the High Court dated 06-02-2015, 23-02-2015 & 03-03-2015 made herein and upon hearing the arguments of Sri A.K. Kishore Reddy, Advocate for the Petitioner and of the GP for Panchayat Raj, (AP), for the Respondents No.1 and 2, and of Sri Ravi Cheemalapati, SC for the Respondent No.3, the Court made the following.
