Heard.

The petitioners intend to sell Plot Nos.32 and 33 situated at Mallapur Village, Uppal Mandal, Ranga Reddy District in favour of purchasers. He states that similar sale deeds in respect of Plot Nos.68 and 69 were already registered by the 3rd respondent but he is insisting on execution of an affidavit by the vendor to declare that the said land is a private land. However, the said declaration is required to be given in the sale deed itself. The present writ petition is filed questioning the action of the 3rd respondent to that extent.

Since the sale deed recitals itself contain necessary averments, the 3rd respondent shall receive and process the document proposed to be presented by the petitioners without insisting upon such an affidavit and examine the document in terms of the Stamp Act and Registration Act and register the same and release it in accordance with due procedure. In the event the 3rd respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Registration Act. Hence, the writ petition is disposed of. No costs.
