THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CONTEMPT CASE No.2086 of 2015 ORDER:
This Contempt Case is filed on the premise that contrary to the orders passed by this Court on 01.05.2015, the Project Director-cum-Joint Secretary, District Water Board Management Agency, Anantapur District, has passed orders in appeal, dated 27.08.2015.
Sri M.S.R.Chandra Murthy, learned Standing Counsel for MGNREGS, has taken prompt steps to produce the note file from the collectorate, Anantapur District, on the appeal submitted by the petitioner herein. Para-wise remarks have been finalized and they were submitted for consideration of the Collector by the Project Director and the Collector has considered the same and agreed with the proposals submitted in the note file. Thus, when once the Collector has signed the note file approving the order put up for consideration, it assumes that the Collector has passed the order. Communication of Collector's order can be done by any one assisting him. Therefore, I do not find any merit in the contempt canvassed in this contempt case. Accordingly, this Contempt Case stands dismissed. However, it shall be open to the petitioner to pursue such remedies available to him under law against rejection order passed by the Collector. No costs.
