HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.8703, 8707, 8716,8719, 8722 and 8723 OF 2015 COMMON ORDER :

As the issue involved in all these writ petitions is one and the same, they are being disposed of by way of this Common order. In all these writ petitions, it is the case of the petitioners that they have been issued show-cause notices dated 18.03.2015 and 19.03.2015 under Sections 42(1) and 43(1) of A.P. Urban Areas (Development) Act, 1975 (for brevity 'the Act') to show cause within seven (7) days as to why such portion of the structure mentioned in the show-cause notices, which is found contrary to the Rules and Regulations shall not be removed so as to bring it in conformity with the approved plan and master plan zoning regulations. In pursuant to the same, petitioners submitted representations dated 24.03.2015, 25.03.2015 and 27.03.2015, but without considering the same, the 2nd respondent-Municipallity is trying to demolish the petitioners' properties, which is subject matter in the impugned notices.

Heard learned counsel for the petitioners as well as Sri Nimmagadda Venkateshwarlu, learned Standing Counsel for the 2nd respondent Municipality.

Since it is stated that explanations filed by the petitioners in pursuant to show-cause notices dated 18.03.2015 and 19.03.2015 are pending with the 2nd respondent Municipality, the 2nd respondent is directed to take an appropriate decision, after considering the explanation of petitioners, in accordance with the provisions under the Act. Till the decision is taken on the show-cause notices, after considering the representations of the petitioners, Status quo obtaining as on today shall be maintained.

With the above direction, writ petitions are disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in these writ petitions, shall stand closed.
