.....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased o issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of mandamus declaring the high handed action of the respondents in disconnecting the water connection to the petitioner's House bearing No.14/230 East Kothapeta, Madanapalle Town, Chittoor District without giving any notice is as illegal, arbitrary, high handed and violation of Article 14 and 21 of the constitution of India and also contrary to the provision of A.P. Municipalities Act, and consequently direct the respondents to restore the water connection to the petitioner's house bearing No.14/230 situated at East Kothapeta, Madanapalle Town, Chittoor District forthwith.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein, and upon hearing the arguments of Sri S. Lakshminarayana Reddy, Advocate for the Petitioner, and of Sri Md. Saleem, Standing Counsel for the Respondents, the Court made the following.
ORDER:
Heard learned counsel for the petitioner.
Mr. Md. Saleem, learned Standing Counsel, takes notice for the respondents and seeks time for getting instructions. Learned Standing Counsel to get instructions as to what is the exact amount of arrears payable by the petitioner towards municipal taxes.
Post after two weeks in Motion List.
Pending further orders, there shall be interim direction to the respondents to restore water supply to the petitioner's house bearing No.14/230 situated at East Kothapeta, Madanapalle Town, Chittoor District, subject to the petitioner paying the entire water charges due.
