THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32635 of 2015 ORDER:

The petitioner was appointed as a Fair Price Shop dealer of Shop No.34, Krosur Village, Krosur Mandal, Guntur District. The authorisation of the petitioner is valid upto 31.03.2016. On 19.08.2015, the Civil Supplies Deputy Tahsildar inspected the shop of the petitioner and found no variation in the stock. However, on the basis of the report submitted by the said Tahsildar on 24.08.2015 the authorisation of the petitioner was suspended pending enquiry. Challenging the same, the present writ petition is filed. It is represented by the learned counsel for the petitioner that a show cause notice was issued on 10.09.2015 and the petitioner submitted his explanation on 21.09.2015.

In the circumstances, what remained is an enquiry. This Court has carefully perused the allegations levelled against the petitioner and is of the opinion that the said charges require enquiry.

In the above circumstances, this Writ Petition is disposed of directing the third respondent to conduct an enquiry in respect of the allegations levelled against the petitioner and pass final orders thereon by giving due opportunity to the petitioner within a period of sixty (60) days from the date of receipt of a copy of this order. There shall be no order as to costs.
