HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12273 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not considering the claim of the petitioner for promotion to the post of Foreman on the ground that he did not possess the requisite qualification, as illegal and arbitrary. None appeared for the petitioner.

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation. Learned standing counsel for the respondent university has submitted that the petitioner is not eligible for promotion to the post of Foreman, as he did not possess the requisite qualification. In view of the above, this Court feels that the relief sought by the petitioner cannot be granted.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
