THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO TRANSFER CMP NO.68 OF 2019 ORDER:

This Transfer CMP is filed seeking transfer of O.P. No.254 of 2018 on the file of Family Court, Warangal to the court of Family Court, City Civil Court, Hyderabad.

The said CMP had been filed by the respondent against the petitioner seeking divorce. The petitioner contends that she is staying in Hyderabad and her financial position is difficult and she cannot travel Warangal. Also she contends that she cannot travel alone to Warangal and her parents are in Hyderabad and are Senior Citizens and are not in a position to accompany her. She stated that the respondent residing in USA and is represented by his father, who is a retired person, and there would be no impediment for GPA holder of the respondent to come to Hyderabad.

Though counsel for the respondent did not agree with the said submission, having regard to the difficulty expressed by the petitioner in attending the Family Court at Hyderabad from Warangal which entails considerable expenditure, and since the GPA holder of the respondent is a retired person who has no impediment to travel to Hyderabad, the Transfer CMP is allowed and O.P. No.254 of 2018 on the file of Family Court, Warangal to transfer to the Family Court, City Civil Court, Hyderabad. No costs.
