HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27842 of 2017 ORDER:

This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to consider the case of the petitioner for promotion as Motor Vehicle Inspector without reference to the charge memo issued by the 1st respondent bearing charge Memo No.4411/V2/2014, dated 29.10.2014, and promote him, as such by declaring the action of the respondents in not considering the case of the petitioner for promotion as illegal, arbitrary, unconstitutional and void, being violative of Articles 14 & 16 of the Constitution of India. 2.

When the matter is taken up for hearing, it is stated by the learned counsel for the petitioner that the lis in this writ petition is squarely covered by the judgment of the Division Bench of this Court in W.P.No.25642 of 2017, dated 02.08.2017. The operative of the said order reads as follows:

"In the light of the above, the Writ Petition is disposed of and the respondents are directed to consider the case of the petitioner for promotion, as and when the Departmental Promotion Committee is constituted, without reference to the charges framed against him, but, however, subjecting such promotion to the outcome of the pending departmental proceedings." 3.

The same is not disputed by the learned Government Pleader for Services for the respondents.

In view of the submission of the learned counsel for the petitioner and the learned Government Pleader for Services for the respondents, this Writ Petition is also disposed of in terms of the
