THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.6184 of 2016 ORDER:

The petitioner assails the order of the Station House Officer, Warangal (Urban), Prohibition and Excise, Warangal District, to hand over the keys and release the stocks i.e., 6500 kgs of white jaggery worth of Rs.65,000/- seized in C.O.R.No.56 of 2016 and for interim custody of the seized white jaggery. The petitioner/A.2 allegedly committed the offence under section 34 (a) & (e) of A.P.Excise Act, 1968 along with another.

Heard both sides and perused the record.

The petitioner/A.2 is a businessman. He proposes to sell the white jaggery. It is not the case of the prosecution that the jaggery is adulterated jaggery. I, therefore, deem it appropriate to order the interim custody of seized jaggery, which is perishable in nature. Accordingly, this Criminal petition is disposed of. Subject to the final orders being passed in the main case, the petitioner/A.2 is granted interim custody of the seized jaggery by the concerned officials on his executing a personal bond of Rs.20,000/- (Rupees twenty thousand only) and on furnishing proof of ownership of the seized property.

Pending miscellaneous applications, if any, shall stand closed in consequence.
