This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner/A-3 in the event of his arrest in connection with Crime No.23 of 2022 of Hanamkonda Police Station, Warangal District, registered for the offences punishable under Sections 417, 420, 467, 468, 471 read with 34 IPC and under Section 66D of Information Technology Act, 2008. 2.
The case of prosecution is that the Controller of Examinations, Kakatiya Univeristy, Warangal, has lodged a complaint stating that they found some fake certificates pertaining to Kakatiya University during the process of verification of some people of the companies i.e., A1-CREST Overseas Consultancy and A2- Imperial Overseas Consultancy, who were involved in the said activities in a big way. 3.
Learned counsel for the petitioner/A3 Mr. S. Surender Reddy, submits that basing on the complaint given by the Professor Mr. P. Malla Reddy, Controller of Examinations, Kakatiya University Campus, Hanamkonda, a case in Cr.No.495 of 2021 on the file of Kakatiya University Campus, Hanamkonda, was registered and in that crime, the petitioner was arrested and remanded to judicial custody on 22.12.2021
LK, J Crl.P.No.1336 of 2022 and later, by order dated 30.12.2021 in Crl.M.P.No.1078 of 2021 in Cr.No.495 of 2021, the learned VI Additional Judicial Magistrate of First Class at Warangal, has enlarged the petitioner on bail observing that the investigation might have completed and the petitioner is ready to cooperate with the investigation. He further submits that basing on the very same allegations, the present complaint is filed, and as the petitioner is ready to cooperate with the investigation, his case may be considered for grant of pre-arrest bail.

On the other hand, learned Assistant Public Prosecutor submits that the petitioner is involved in a case of fake certificates of Kakatiya University and several complaints were received in this regard. He submits that in view of the allegations leveled against the petitioner and as the investigation is pending, he is not entitled for pre-arrest bail. 5.
Taking into consideration the fact that earlier the petitioner/A3 was granted bail by the Court below by order dated 30.12.2021 in Crl.M.P.No.1078 of 2021 in Cr.No.495 of 2021, in respect of the complaint lodged by the Controller of Examinations, Kakatiya University, this Court deems it appropriate to grant pre-arrest bail to the petitioner-A-3. 6.
The Criminal Petition is allowed. Petitioner - Accused No.3 shall surrender before the Station House Officer, Hanamkonda Police Station,
LK, J Crl.P.No.1336 of 2022 Warangal District, in connection with Crime No.23 of 2022 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. Petitioner shall cooperate with the investigation. If the petitioner involves in any further offences, the prosecution is at liberty to move an appropriate application for cancellation of bail.
