THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.464 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/accused in C.C.No.192 of 2016 on the file of the Court of the XXI Special Magistrate at Erramanzil, Hyderabad.

At the time of hearing, learned counsel for both parties submitted that the petition filed before this Court was marked as Ex.P.15 in the trial Court.

Mere marking of the document would not amount to proof of recitals of the same. In view of the submission made by the learned counsel for both parties, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned XXI Special Magistrate at Erramanzil, Hyderabad, is hereby directed to consider the probative value of Ex.P.15 and pass appropriate orders in accordance with law.

With the above direction, the Criminal Petition is disposed of. 6.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
