Indirapalli Yadaiah, v. The State Of Telangana
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Appeal No.250 of 2018 And Writ Petition No.1845 of 2018 COMMON JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for some time, Learned Counsel on either side would agree that, instead of deciding the appeal which is preferred against the interlocutory order passed by the Learned Single Judge in W.P.No.1845 of 2018 dated 24.01.2018, the Writ Petition itself be disposed of directing the Joint Collector, Ranga Reddy District to dispose of the appeal preferred by the respondent-writ petitioner against the order passed by the Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District, granting Occupancy Rights Certificate in favour of the parents of appellants 2 to 12.
As Learned Counsel on both sides are in agreement, we consider it appropriate to dispose of the Writ Petition itself directing the Joint Collector, Ranga Reddy District (2nd respondent in both the Writ Appeal and the Writ Petition) to dispose of the appeal preferred by the respondent-writ petitioner against the order passed by the Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District dated 25.06.2016 granting Occupancy Rights Certificate in favour of the parents of appellants 2 to 12.
The Joint Collector, Ranga Reddy District shall dispose of the appeal, preferred by the respondent-writ petitioner against the order passed by the Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District, within two months from the date of
receipt of a copy of this order. Till the appeal is finally disposed of, the interim order passed by the Learned Single Judge shall continue to operate.
Both the Writ Appeal and the Writ Petition are, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) _________________________________ (KONGARA VIJAYA LAKSHMI, J) Date:19th February, 2018.
