The Government proposed to resume the land admeasuring Ac.4-80 cents in Sy.No.369/3 situated at Koduru Village, Anakapalle Mandal, Visakhapatnam District, which was originally assigned to one M.Ranga Rao under ex-servicemen quota under proceedings DR.No.121/1994, dated 20-05-1985 and which was purchased by the petitioners from the said ex-serviceman under a registered sale deed, dated 16-10-1995 and accordingly, the 3rd respondent issued notice, dated 14-07-2015, requiring the petitioners to submit explanation. The petitioners stated to have submitted explanation on 28-07-2015 and also served legal notice, dated 1911-2015 to respondents 2 and 3 seeking compensation. The petitioners state that respondents are interfering with their possession without following the due process of law.
Learned Government Pleader for Revenue states that notice itself was issued in July, 2015 and if no orders are passed so far, the explanation given by the petitioners would be duly considered.
Therefore, the writ petition is disposed of directing the 3rd respondent to consider the explanation of the petitioners and pass appropriate orders in accordance with law. Till passing of such orders, if no orders are passed as of now, the petitioners' possession shall not be interfered by the 3rd respondent.
