THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.15616 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader.

2. The prayer is one of inaction in disposing of representations dated 09.11.2015 and 23.11.2015 filed by the petitioners complaining against the alleged acts of forgery, misappropriation and corruption by respondents 5 and 6.

3. I have perused the representation dated 23.11.2015 and it is matter of record the representation is also acknowledged by the office of third respondent. This Court is of the view that in fitness of things appropriate enquiry ought to have been ordered by now to find out the truth in the complaint and if the complaint warrants further action appropriate steps are initiated in accordance with law.

4. There is certainly delay in disposing of the representation. Hence, I am satisfied the writ petition can be disposed of by directing the third respondent to consider and if necessary enquire into the allegations stated in the representations dated 09.11.2015 and 23.11.2015 and if circumstances warrant, take action in accordance with law within a period of two (2) months from the date of receipt of a copy of this order. Petitioner is given liberty to communicate this order within two (2) weeks from today. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
