HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 1305 OF 2022 O R D E R:

This Criminal Petition under Section 438 Cr.P.C., is filed by the petitioners- Accused Nos.2 to 6 seeking bail in the event of their arrest in connection with Crime No.22 of 2022 on the file of Chennaraopet Police Station, Warangal District, registered for the offences punishable under Sections 376-N, 420 and 417 I.P.C.

The case of the prosecution is that the de facto complaint lodged a report stating that herself and Accused No.1 were fell in love with each other from the last four years, and on the pretext of marriage, accused No.1 has committed rape on her in the year 2018 and thereafter, he contacted her physically several times whenever he came to her village. Thereafter, accused No.1 demanded an amount of Rs.25,00,000/- in the presence of these petitioners-accused Nos.2 to 6. Hence, the present complaint.

Learned counsel for the petitioners-accused Nos.2 to 6 would submit that the petitioners have nothing to do with the offences alleged against them. He submitted that the entire allegations are against accused No.1 only and this Court vide order, dated 15.02.2022 in Crl.P.No.1179 of 2022, granted bail to the accused No.1. He further submitted the petitioners are family members of accused No.1 and they have been falsely

implicated in this case for the alleged offences and hence, their case may be considered for grant of bail.

Taking into consideration the allegations levelled against accused No.1 and he was already granted bail by this Court, it is appropriate to grant pre-arrest bail to the petitioners-accused Nos.2 to 6.

The Criminal Petition is allowed. Petitioners - Accused Nos.2 to 6 shall surrender before the Station House Officer, Chennaraopet Police Station, Warangal District, in connection with Crime No. 22 of 2022 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer, they shall be released on bail. It is made clear that no further extension of time will be granted.

Miscellaneous petitions, if any, pending shall stand closed.
