HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 1098 of 2011 Order:

This Criminal Petition is filed by the petitioner/accused, under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the FIR registered against him in Crime No. 38 of 2011 of Humayunnagar Police Station, Hyderabad, for the offence punishable under Section 353 IPC.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State. The second respondent herein, who is working as Inspector of Police, Humayunnagar Police Station, Hyderabad, filed a complaint alleging that on 20.01.2011, at about 18.30 hours, while he along with other police personnel was checking the vehicles at Ahmed Nagar, the petitioner/accused, being a Corporator of Ahmed Nagar along with his associates of about 100 persons, came there and obstructed the police personnel from discharging their lawful duties by raising slogans against the police and laid themselves down on the road in front of the police vehicle.

A perusal of the complaint shows that it is a fit case where the matter needs to be investigated. There are no valid grounds to quash the FIR.

In the facts and circumstances of the case and since the petitioner/accused is said to be Corporator of Ahmed Nagar area, the Criminal Petition is disposed of directing the Station House Officer, Humayunnagar Police Station, Hyderabad, not to arrest the petitioner/accused herein, but however, the investigation shall continue to its logical end and the petitioner shall co-operate with the investigating agency for smooth completion of the investigation. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed.
