HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13072 of 2017 ORDER:

The case of the petitioners is that they have submitted representation dated 07.04.2017 before the 4th respondent seeking permission to dig the bore-well, as the existing bore-well got damaged. As no orders are passed on the said representation, present writ petition is filed. Learned counsel for the petitioners submits that lemon trees are existing in the subject land and that unless permission is granted to dig the bore-well, the entire lemon garden will be damaged.

Learned Assistant Government Pleader for Revenue submits that the petitioners have to make application in Form-2 under Rule-13 of the Andhra Pradesh Water, Land & Trees Act, 2002 (for short the Act, 2002).

In view of the above, it is open for the petitioners to make application in Form-2 under Rule13 of the Act, 2002 by paying necessary fee before the 4th respondent and on such application being submitted by the petitioners, the 4th respondent is directed to consider the same and pass orders, in accordance with law, within a period of one week from the date of receipt of application from the petitioners.

Accordingly, the writ petition is disposed of. No order as to costs.
