THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7429 of 2012 ORDER:
This Criminal Petition is filed by the petitioners - accused Nos.7 to 10, 12, 15, 16, 18 to 23, 25 to 27, 29 to 33, 37, 41 to 44, 48, 52, 54, 56 to 62, 64, 65 & 68 under Section 482 Cr.P.C., to quash the proceedings against them in Crime No.160 of 2011 on the file of I-Town Police Station, Adilabad, registered for the offences punishable under Sections 3 & 4 of the A.P. Land Grabbing (Prohibition) Act, 1982, Sections 34, 420, 468 and 471 IPC.
Heard and perused the material available on record. The learned counsel for the petitioners submitted that the petitioners are no way concerned with the alleged offences and the allegations are mainly against A1 only and therefore, continuation of proceedings against the petitioners is nothing but abuse of process of law and hence, he prays to allow the petition. A perusal of the record discloses that there are specific allegations against the petitioners and therefore, this is a matter, which has to be investigated into by the police. Hence, this Court is not inclined to quash the proceedings against the petitioners in the said crime at this stage. However, considering the facts and circumstances of the case, the police concerned are directed to complete the investigation of the case and file final report, if any, without arresting the petitioners. The petitioners are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the investigation. If the petitioners are aggrieved by the
final report, if any filed by the police, they are at liberty to approach this Court.
With the above observations, the Criminal Petition is disposed of. Miscellaneous Petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J August 27, 2016.
