R.Vijayanand, S/o R.V.Koteswara Rao ..... Petitioner And:
The Commissioner and Director of Municipal Administration, Hyderabad and another.
.....Respondents Counsel for the petitioner: Mr. K.Ram Reddy Counsel for the respondents: GP for Services (TS) The Court made the following:
CVNR, J & GSP, J WP.No.22734 of 2017 Dated:06.9.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed feeling aggrieved by nonimplementation of order, dated 28.9.2012, in Original Application No.2349 of 2010 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal'). By the afore-mentioned order, the Tribunal has set aside the proceedings of respondent Nos.1 and 2, whereunder the petitioner was reverted from the post of Accountant to the post of Senior Assistant. Admittedly, the said order has become final as, the same was not challenged by the respondents by availing a legal remedy. Though the said order has attained finality, the respondents have failed to implement the same for the last five years. Feeling aggrieved by the inaction of the respondents, the petitioner filed this Writ Petition.
At the hearing, respondent No.1 is personally present. Learned Government Pleader for Services (Telangana) has placed before us proceedings in Roc.No.295/6166/2010-C1, dated 05.9.2017, of respondent No.1 posting the petitioner as Accountant in Kothagudem Municipality.
Respondent No.1 has informed the Court that she was not apprised of the afore-mentioned order of the Tribunal and that therefore, she could not cause implementation of the same earlier.
CVNR, J & GSP, J WP.No.22734 of 2017 Dated:06.9.2017 Writ Petitions of this nature complaining nonimplementation of the orders of the Tribunal, which attained finality, galore.
If the subordinate staff have not brought the said order of the Tribunal to the notice of respondent No.1, they are liable to be proceeded with departmentally. Accordingly, respondent No.1 is directed to identify the officers who are responsible for not taking appropriate action for implementation of the said order of the Tribunal and initiate departmental proceedings against them.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel, WPMP.No.27998 of 2017 stands disposed of as infructuous.
