Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondent No.2. In this writ petition, grievance of the petitioner is that though he submitted representations dated 19.12.2019 and 29.01.2020 to respondent No.2 stating that respondent Nos.3 to 5, who are his relatives, are proceedings with the illegal constructions in respect of house bearing No.4-21, near Hanuman Temple, Mallampet, Dundigal, Gandimaisamma, Medchal-Malkajgiri District, without obtaining permission, no action has been taken thereon. Admittedly, with respect to the subject premises, the petitioner filed O.S.No.275 of 2019 in the Court of Junior Civil Judge, Medchal District and the same is pending. The petitioner submitted applications dated 19.12.2019 and 29.01.2020 to respondent No.2. In view of the same, respondent No.2 is duty-bound to verify whether the construction being made by respondent Nos.3 to 5 is in accordance with the permission granted by the Municipality and whether such permission is obtained by suppressing the fact of pendency of the above said suit.
In those circumstances, the writ petition is disposed of with the direction to respondent No.2 to redress the grievance of the petitioner by taking into consideration the representations
submitted by him, by following the procedure prescribed under law, after issuing notice to respondent Nos.3 to 5. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:06.03.2020 kdl
