This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is A1, in Cr.No.153 of 2016 on the file of the Station House Officer, S. Kota Police Station, Vizianagaram District. The offences alleged are under Sections 8(c) read with 20(b)(ii) of NDPS Act. 2.
Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

As per the case of the prosecution, 30 Kgs of Ganja was seized from the possession of the accused, who are three in number. It is brought to the notice of this Court that the earlier bail petition filed before the Court below was dismissed.

Hence, considering the facts of the case, this Court does not find it a fit case for grant of anticipatory bail. However, the petitioner is at liberty to approach the concerned Court having jurisdiction and seek regular bail. On such petition being filed, the concerned Court shall dispose of the same, on merits, on the same day subject to pressure of work.
The criminal petition is dismissed.
