THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.228 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A6 to A8 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in Crime No.275 of 2015 on the file of KPHB Police Station, Cyberabad, registered for the offence punishable under Sections 406, 420 and 506 IPC.

Heard and perused the material available on record. It is alleged that the complainant, who is a software engineer, used to go to abroad on his professional work. A1, who is his wife, is residing in Hyderabad. The complainant was induced to purchase lands in Hyderabad and other places. Later, on coming to know that A1 developed illegal affairs, the complainant came to India. A1 and other accused quarreled and necked out the complainant. On 1.3.2015, all the accused trespassed into the house of the complainant, beat him and refused to pay the entire amount and threatened him.

Learned Counsel for the petitioners submitted that NBWs are pending against the petitioners.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The petitioners-A6 to A8 are directed to surrender before the Court concerned and move an application to recall NBWs issued against them. On such surrender and on such application being filed, the Court concerned is directed to recall NBWs issued against the petitioners and release them on bail on each of them executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with one surety for the like sum each to the satisfaction of the Court concerned. The petitioners are directed to appear before the Court concerned regularly.
