Syed Muneeruddin v. The State Of Telangana
THE HON'BLE DR.JUSTI CE SHAMEEM AKTHER CRI MI NAL PETI TI ON No.1 4 1 0 OF 2 0 1 9 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.2 to A.9 to quash the proceedings in P.R.C.No.7 of 2018 pending on the file of the Special Judicial Magistrate of First Class (Prohibition & Excise Offences) at Nalgonda.
2.
Heard the learned counsel for the petitioners/ A.2 to A.9, the learned Additional Public Prosecutor representing respondent No.1/ State and perused the record. 3.
It has been contended that the petitioners are living at different places and no cause of action arose at the said places. Further, no offences under Sections 307, 323, 324, 498-A, 504 and 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act are made out against the petitioners and ultimately prayed to quash the above proceedings.
4.
It is pertinent to state that the committal Court has to examine the record and find out whether the offences triable by the Court of Sessions are made out or not. In the event, the committal Court comes to a conclusion that the allegations constituting the offences triable by the Court of Sessions are made out, then only it has to commit the case to the Court of Sessions. 5.
In view of the above, the committal Court is directed to examine the record and pass an appropriate committal order.
6.
With the above observation, the Criminal Petition is disposed of.
Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
