THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17574 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the 2nd respondent in providing drinking water to the petitioners residential houses as well as streets situated at Muthyal Reddy Palli, L.B.Nagar and Santhinagar Madigawada Colonies, Tirupathi Rural Mandal, Chittoor District is illegal, arbitrary, unconstitutional, violation of Article 14 of the Constitution of India and violation of fundamental rights guaranteed under the Constitution of India and consequently direct the 2nd respondent to dispose of the representation of the petitioners dated 9.11.2016 by providing drinking water tap connections to the residential houses of the petitioners as well as in the street drinking water tap connections to the petitioner above colonies forthwith and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Case of the petitioners is that they belong to SC and ST communities and they constructed small houses in the aforesaid areas and for the last 20 years, they are residing in the said houses without any basic amenities. Hence, they made several representations to respondent No.2 to provide drinking water to their colonies. They are also willing to pay the requisite fee for providing individual water tap connection to their residential houses, but respondent No.2 did not act upon their representations. In fact, they are having electricity connections to their houses and the autorities have issued Aadhar Cards, Voter

I.D. Cards and also Ration Cards. They are drinking bore well water for the past several years. They also made a representation on 09.11.2016 to respondent No.2 praying to provide drinking water connections to their colonies, but no action has been taken till date. Hence, they filed the present writ petition. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioners, respondent No.2 is hereby directed to consider the representation, dated 09.11.2016, of the petitioners and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of four (4) weeks from the date of receipt of a copy of this order. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
