THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.18873 OF 2007 ORDER:
This writ petition is filed seeking to declare the action of the respondents in taking steps to dispossess the petitioners from the land admeasuring Ac.3.08 guntas in Sy.No.21 of Hussainpur village, Toopran Mandal, Medak District, even though the petitioners were granted succession certificate from the concerned authorities in respect of the above extent, which was devolved through their predecessors, as illegal, arbitrary, unjust and violative of Articles 14 and 300-A of Constitution of India and consequently direct the respondents to consider the application submitted by the petitioners under Section 32 of A.P., (Telangana Area) Tenancy and Agricultural Lands Act, 1950 and declare them as protected tenants of the above extent accordingly mutate the names of the petitioners in revenue records and issue pattadar pass books and title deeds.

It is the case of the petitioners that they are the legal heirs of the protected tenants in respect of the land admeasuring Ac.3.08 guntas in Sy.No.21 of Hussainpur village, Toopran Mandal, Medak District, but the second respondent erroneously trying to dispossess them from the said land. The petitioners made an application to the respondents under Section 32 of the A.P. (Telangana Area) Tenancy and Agricultural Lands Act, 1950 and the respondents raised certain objects to grant tenancy certificate to them. The petitioners also made another application dated 19.7.2007 to the respondents to consider their application filed
under Section 32 of the A.P. (Telangana Area) Tenancy and Agricultural Lands Act, 1950.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents not to dispossess the petitioners from the subject land without following due process of law and also to consider the request of the petitioners made to the respondents in accordance with law as expeditiously as possible.
