.....Respondents The Court made the following:
HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner alleges that when he wanted to lodge a complaint on 18.02.2019, the Station House Officer of Tappachabutra Police Station (6th respondent) refused to receive the complaint and, therefore, complaint was addressed to the Director General of Police, and marked the copies to various Officers, and copy was also sent through registered post to the 6th respondent. Alleging inaction in registering the complaint, this writ petition is filed. 2.
As complaint was sent only on 18.02.2019 through registered post, it cannot be said that there is inordinate delay on the part of Police in receiving the complaint and not acting upon the complaint. This Court is not inclined to entertain the writ petition at this stage.
3.
On elaborate consideration of the issue and having regard to the law laid down by the Supreme Court, this Court in W.P.No.38397 of 2018 and batch, dated 8.3.2019 held that petitioners have to avail statutorily engrafted remedies available to them on issue of non-registration of crime and cannot directly invoke the jurisdiction of this Court.
4.
Having regard to the view taken by this Court in W.P.No.38397 of 2018 and batch, dated 8.3.2019, this Writ Petition is also not maintainable and is accordingly dismissed. It is made clear that there is no opinion expressed on the content of complaint. Petitioner is at liberty to avail statutory remedy
ventilating his grievances against delay in registration of crime. Pending miscellaneous petitions shall stand closed. ___________________________ JUSTICE P.NAVEEN RAO Date: 12.03.2019 kkm
