HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.24582 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleaders for Land Acquisition and R & B respectively for respondents from the oral instructions and perused the prayer in the writ petition with the supporting affidavit and the other material on record.

Undisputedly, the petitioner claiming as owner of the property in question could not even file a scrap of paper. No doubt, even an encroacher cannot be dispossessed if he is in settled possession as encroacher, except following due process of law.

Having regard to the above and in the result, the Writ Petition itself is disposed of, for any widening of the road even the Government land under encroachment of the petitioner, they have to follow due process to remove.

Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
