THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39190 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Panchayat Raj for the respondents 1 to 3 and Sri Ravi Cheemalapati for the 4th respondent. 2.

Petitioners apprehension is that the 4th respondent - Gram Panchayat is proposing a construction on the road margin between petitioners land and an existing road, which allegation is denied by the 4th respondent - Gram Panchayat in its counter affidavit. It is also stated in the counter affidavit that they will ensure that even if such construction is made, access to the petitioners' land will not be blocked in any way.

Having regard to the stand taken by the 4th respondent, it is directed that the respondent shall not, in any way, obstruct the access of the petitioners from their land to the road by making any construction in the available space between the petitioners' land and the road.

Accordingly and with the above direction, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed as consequence. There shall be no order as to costs. ______________________________ M.S.RAMACHANDRA RAO, J 03.07.2018 SS
