Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents. 2.

Petitioner alleges that even though no crime is registered against the petitioner and is no way concerned with the Crime No.464 of 2016 reported on 14.07.2016 by Smt. M. Sandhya Sudhakar, police are harassing the petitioner by calling him to police station very often over phone.

Prima facie reading of complaint lodged by Smt. M. Sandhya Sudhakar, there is no mention in the said complaint on the role of the petitioner.

According to learned Government Pleader, while examining L. Somaiah, he deposed that he signed as a witness as requested by petitioner in the agreement of sale, dated 22.11.2012, and later re-conveyance deed, dated 03.12.2012. Though name of petitioner was not mentioned in the complaint, based on the statement of L.Somaiah, petitioner was called to police station for further investigation.

Thus, though so far, petitioner's involvement is not established, the relevance of statement given by L. Somaiah may require further investigation to find out the person who alleged to have executed the document on the subject property claimed by the complainant. But, unless crime is registered against the petitioner/he is added as accused in Crime No.464 of 2016, he

shall not be harassed and frequently asked to come to police station. Further, if any information is required from the petitioner, police shall follow due process to conduct investigation in Crime No.464 of 2016. However, it is needless to observe that if the petitioner is shown as accused in any crime or if his name is also shown as accused in Crime No.464 of 2016, this order does not come in the way of police proceeding in accordance with law. 5.

The Writ Petition is accordingly disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
