THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.28111 OF 2016 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 to 4. This Writ Petition is filed to declare the action of the 4th respondent in not issuing the Family Member Certificate, since the husband of the 1st petitioner died on 16.06.2016, as illegal and arbitrary.
The grievance of the petitioners is that though the 1st petitioner made an application before the 4th respondent for issuance of Family Member Certificate, he has not taken any action so far.
Since the dispute is civil in nature, it cannot be resolved in this Writ Petition. The petitioners have to approach appropriate Civil Court and obtain a declaration as regards Family Member Certificate. In view of the same, I am not inclined to entertain the Writ Petition and the same is liable to be dismissed. The Writ Petition is accordingly dismissed. However, the petitioners are given liberty to agitate their rights before the appropriate civil Court. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
