Heard learned counsel for petitioner and learned Government Pleader for Revenue (AP) for respondents. 2.
Petitioner was assigned house site plot no.3 to an extent of Ac.0.021⁄2 cents in Sy.No.297/20 of Kandukur village, Prakasam district vide proceedings Rc.No.133/93, dated 06.04.2000.
Petitioner sought for conducting of survey in the said survey number. Alleging inaction on the request made by the petitioner, this writ petition is filed.

When the matter is taken up for consideration, learned Government Pleader produced the written instructions furnished to him. The written instructions would disclose that petitioner did not occupy the land allotted to him and did not undertake construction of the house as required. Later, Smt.Putta Anjamma and Smt. Putta Sujatha occupied the very same land and constructed two portion house and living therein. They were also given municipality assessment number and Electricity Department has also provided electricity connection. Those two individuals instituted O.S.No.427 of 2015 on the file of Principal Junior Civil Judge, Kandukur, praying to grant permanent injunction and the same is pending consideration, wherein the petitioner herein is the defendant. Petitioner was given intimation narrating all these facts. 4.
It appears, by the decision dated 10.12.2015, request of the petitioner was rejected though it does not refer to conducting of survey at the request made by the petitioner.

Having regard to these facts, Court is not inclined to grant direction at this stage. Thus, leaving it open to the petitioner to work out his grievance and to prosecute the pending suit, writ petition is dismissed.
