HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.5104 of 2020 ORDER:

The petitioners challenge the notices purported to have been issued by the 2nd respondent in terms of Sections 192 and 194 of the A.P. Municipalities Act, 1965. One of the grounds raised by the petitioner is that the A.P. Municipalities Act, 1965 is no longer in force as it was repealed under Section 299 of the Telangana Municipalities Act, 2019 (Act 11 of 2019).

Having perused the Act 11 of 2019, particularly, Section 299 of the said Act, it is clear that from the date of commencement of the Act 11 of 2019, the A.P. Municipalities Act, 1965 and the Telangana Municipal Corporation Act, 1994 are repealed with effect from 09-10-2019, the date of publication of the Act in the Gazette.

Accordingly, the Writ Petition is allowed and the impugned notices are declared as ultravires and accordingly they are quashed. No costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
