HON'BLE SRI JUSTICE S.V.BHATT W.P.No.8713 OF 2008 ORDER:

Heard counsel for petitioner.

The petitioner prays for Mandamus declaring the action of respondents in not releasing annual grade increments of petitioner for certain periods, as illegal, arbitrary and violative of principles of natural justice.

This Court, on 04.09.2008, granted interim direction as follows. "Heard both sides.

It appears, petitioner was suspended from service. The departmental proceedings ended with punishment of recovery of certain amounts from the petitioner, but how the period of suspension was treated was not taken care of. The learned counsel for the petitioner states that though the petitioner is entitled to the increments even for the period during which he was under suspension, the same were not granted. However, some increments were granted up to 2004 and thereafter the same were stopped.

In view of the above, the respondents are directed to grant all the annual grade increments due to the petitioner even for the period for which he was under suspension. The respondents shall pass appropriate orders as per law within a period of four weeks from the date of receipt of this order and communicate the same to the petitioner.

The WPMP is accordingly disposed of".

The same is subsisting as on date.

Hence, the interim order can be made final order in the writ petition.

The writ petition is, accordingly, disposed of by making the interim order as final order in the writ petition. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
