This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners/ accused 2 and 3 to quash the proceedings in C.C.No.12 of 2018 on the file of the XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, wherein the Petitioners are being prosecuted for the offences under Section 498A, 406 and 420 I.P.C and Sections 4 and 6 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners/ accused 2 and 3 and the learned Additional Public Prosecutor representing the respondent No.1-State and perused the record. 3.

Having argued the matter for some time, learned counsel for the petitioners/ accused 2 and 3 submitted that the personal appearance of the petitioners before the trial Court may be dispensed with.

The allegations leveled against the petitioners/ accused 2 and 3 constitute offences under Sections 498A, 406 and 420 I.P.C and Sections 4 and 6 of Dowry Prohibition Act and there are no grounds to quash the proceedings. However, in case of any difficulty for the petitioners/ accused 2 and 3 to appear before the Court, they are entitled to file an application seeking dispensation of their presence. In the event of such application being filed, the trial Court may consider the same.
