HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2635 of 2017 ORDER :

This criminal petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to enlarge the petitioner/A.1 on bail in the event of his arrest in connection with Crime No.4 of 2017 of Prohibition and Excise Station, Bellampalli, registered for the offence punishable under Rule 27(1) of A.P. Excise (Grant of licence to sell toddy condition of licence & Tapping of Excise Trees), Rules, 2007, apprehending his arrest. 2.

After arguing the matter for some time, Sri V. Ravi Kiran Rao, , learned counsel for the petitioner, requested this Court to permit the petitioner to surrender before the concerned Magistrate, and on such surrender, if any application is filed for grant of bail under Section 437 Cr.P.C., after serving notice on the Assistant Public Prosecutor, the learned Magistrate may be directed to decide the petition on the same day.

Acceding the request of the petitioner, without going into the merits of the case, I deem it appropriate to direct the petitioner to surrender before the concerned Magistrate and on such surrender, if any application is filed under Sections 437 or 439 Cr.P.C., after serving notice on the Assistant Public Prosecutor, the Presiding Officer is directed to decide the petition on the same day in accordance with law.

With the above direction, the criminal petition is disposed of. 5.
