SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1499 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is A-1 in Crime No.130 of 2017 on the file of the Station House Officer, W.P.S. Police Station, Warangal District. The offences alleged are under Sections 498-A, 307 and 506 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
Heard the learned counsel for the petitioner/A-1, learned Public Prosecutor appearing for the respondent-State, and perused the record.
Learned Public Prosecutor brings to the notice of this Court that earlier this Court, by considering the merits of the case, dismissed the application for grant of anticipatory bail. A perusal of the order dated 30.10.2017 passed in Criminal Petition No.9563 of 2017 shows that anticipatory bail was not granted to this petitioner-A1, though it was granted to A-2 and A-3.
The nature of the allegations does not entitle the petitioner for grant of anticipatory bail.
Considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law, on the same day subject to the regular pressure of work.
With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
