THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11462 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-Accused No.1 seeking to relax the conditions imposed by the VI Additional Chief Metropolitan Magistrate, FAC XIV Additional Chief Metropolitan Magistrate, in Crl.M.P. No.1177 of 2015, while granting statutory bail to the petitioner vide order dated 15.4.2015.

While granting bail to the petitioner, the learned Magistrate directed him to execute a personal bond for a sum of Rs.5 lakhs with two sureties each having immovable property in twin cities of Hyderabad and Secunderabad. In pursuance of the said order, the petitioner furnished two sureties by depositing the title deeds of immovable properties of the sureties. Now the petitioner seeks to relax the said condition.

Learned Counsel for the petitioner submitted that the petitioner is ready to deposit a sum of Rs.5 lakhs fixed deposit receipts instead of immovable properties.

The learned Special Standing Counsel for CBI opposed this petition and informed that if the property documents are returned, it is very difficult to secure the petitioner for the purpose of trial. Considering the fact that the petitioner is working in Hyderabad and his family members are living in Secunderabad, this Court is of the view that the modification of the above condition can be ordered. The petitioner is directed to deposit Fixed Deposit Receipts for

a sum of Rs.5,00,000/- (Rupees Five Lakhs only) each of two sureties. On such deposit, the learned Magistrate shall return the original property documents of the sureties.
