Heard the learned counsel for the petitioner/ A.2, the learned Additional Public Prosecutor representing the respondent/ State and perused the record.

It is brought to the notice of this Court that some of the accused were extended the benefit of Section 167(2) of Cr.P.C. and the petitioner/ A.2 intends to seek the same relief before the Court concerned.

Under these circumstances, the Criminal Petition is dismissed giving liberty to the petitioner to move an application under Section 167(2) Cr.P.C. before the Court concerned.

Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
