HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 1469 of 2017 ORDER:

The case of the petitioners is that they have filed an appeal before the II Additional District Judge, R.R.District-cumChairman Land Reforms Appellate Tribunal, R.R.District in L.R.A.No.12/2009 against the common orders of the Land Reforms Tribunal passed under Section 9 of Andhra Pradesh Land Reforms (COAH) Act, 1973 in C.C.Nos.1471/E/75, 1473/E/75 and 1472/E/75 dated 27.04.1976 and the said appeal was allowed vide order dated 15.11.2014 directing the Lower Tribunal to give exemption to an extent of Ac.14.6 guntas of land from the holding of the declarant i.e., Agi Reddy and pass appropriate orders declaring the said Agi Reddy as non-surplus land holder under the provisions of A.P.Land Reforms Act. In pursuant to the same, notice was issued to the petitioners vide proceedings in Lr.No.E/1471, 1472, 1473/75 asking them to appear before the Special Grade Deputy Collector & Revenue Division Officer. Though petitioners appeared before the said authorities, the matter is kept pending as on today. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. Since 2nd respondent has already issued notice to the petitioners to appear before the Special Grade Deputy Collector & Revenue Division Officer and petitioners appeared accordingly, there is no reason why subsequent action has not been taken.

In view of the same, the 2nd respondent is directed to pass appropriate orders, after giving opportunity of hearing to the parties in the said notice, within a period of eight (08) weeks from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ___________________________ A.RAJASHEKER REDDY,J 17.01.2017 dv
