THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5119 of 2020 ORDER:

In this Writ Petition, grievance of the petitioner is that the second respondent is encroaching upon his land to an extent of 17 Sq.yards towards northern side.

Heard learned counsel for the petitioner and learned Standing Counsel for Nalgonda Municipality appearing for the second respondent.

Even assuming that the petitioner's allegations against the second respondent are true and correct, in writ jurisdiction, it is not possible for this Court to enquire as to whether 17 Sq.yards or 70 Sq.yards have been encroached upon by the second respondent.

Therefore, this Writ Petition is closed granting liberty to the petitioner to approach the civil Court seeking appropriate relief. Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
