This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused to quash the proceedings in C.C.No.388 of 2018 on the file of the II Special Metropolitan Magistrate, Rajendranagar, Ranga Reddy District, registered for the offences punishable under Sections 341 & 427 of IPC.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

As per the material placed on record, the petitioner/ accused, without obtaining any permission from the authorities concerned, constructed a pedestal in front of Ramanjaneyaswami temple for installing the statue of his father. The pedestal said to have constructed restrains the devotees from entering into the temple and moving around that area. Furthermore, there is damage to the public property. Therefore, all the requirements of Sections 341 & 427 of IPC are made out against the petitioner/ accused. Under these circumstances, there are no grounds to quash the proceedings against the petitioner/ accused in the impugned Calendar Case. 4 .

Hence, the Criminal Petition is dismissed. It is made clear that the observations made hereinabove shall not have

any bearing on the adjudication of the subject Calendar Case by the trial Court.

Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
