HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4310 of 2018 ORDER:
This Writ Petition is filed for a Mandamus declaring the proceedings dated 26.10.2017 of respondent No.3, cancelling the petitioner's fair price shop authorization in respect of shop No.22, G.Jambuladinne Village, Allagadda Mandal, Kurnool District, as illegal and arbitrary.
I have heard Sri Niyatha, learned Counsel for the petitioner, and perused the record.
The petitioner was appointed as a temporary fair price shop dealer of Shop No.22, G.Jambuladinne Village, Allagadda Mandal, Kurnool District. Alleging that the petitioner had committed irregularities in distribution of essential commodities to the cardholders, her authorization was suspended by the impugned proceedings and also respondent No.3 issued a show cause notice on 26.10.2017. In reply to the show cause notice, the petitioner is stated to have filed her explanation on 19.12.2017. The petitioner has also filed an appeal before respondent No.2 against the order of suspension of her authorization and the said appeal is stated to be pending.
Learned Counsel for the petitioner submits that, since the appeal filed by the petitioner against the order of suspension is pending before respondent No.2, respondent
No.2 may be directed to dispose of the appeal within a reasonable time.
In view of the above submission of the learned Counsel, the Writ Petition is disposed of with the direction to respondent No.2 to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of the order. Till such time, the impugned proceedings dated 26.10.2017 are stayed.
As a sequel, miscellaneous petitions pending, if any, stall stand disposed of.
